General Conditions of Sale
- A.D.O. Medical reserves the right to modify at its sole discretion the rules governing these General Conditions as well as the economic conditions applied to the same (due to changes in conditions, foreign currency exchange rates, increases in the cost of raw materials, or any other reason). Unfavorable changes will be communicated to the Customer by email to the last address provided by the latter. In case of unfavorable changes, the Customer may withdraw from the contract within 15 days of receiving the relevant communication. Otherwise, the changes will be considered accepted.
- A.D.O. Medical reserves the right, at its sole discretion, not to accept incomplete or improperly filled orders. It also has the right to withdraw from the contract or suspend its execution at any time without notice and without any compensation or damages being due to the buyer.
- A.D.O. Medical does not provide products on a trial basis. The Customer is responsible for choosing the ordered products and ensuring they meet their needs.
- The delivery terms, if indicated, are merely indicative. Any delays cannot give rise to disputes, claims for compensation, or justify the cancellation of the order. Orders received may be processed partially, depending on stock availability or the manufacturer's preparation times. Additionally, A.D.O. Medical is not responsible for service disruptions due to force majeure of any kind if it is unable to fulfill the requested supply within the agreed timelines specified on the Shipping and Payments page. Examples of force majeure include, but are not limited to, public authority measures, strikes by its own employees, third-party employees, or those of carriers utilized by A.D.O. Medical, as well as any circumstances beyond its control.
- A.D.O. Medical delivers the ordered products to the Customer using the methods specified on the Shipping and Payments page, via trusted couriers, freight forwarders, or its own representatives. Product delivery is subject to the Customer's payment of the relevant price using one of the methods offered by A.D.O. Medical.
- Tax documentation (invoice) is issued by A.D.O. Medical based on the User's data provided during registration on the site or during the checkout process for unregistered users.
- Unless otherwise agreed, goods are transported via couriers affiliated with A.D.O. Medical and at the Customer's sole risk. A.D.O. Medical is not responsible for any damages to products during transportation. Customers are advised to inspect the integrity of the packaging upon receipt and, if necessary, accept the goods "with reservation" (sign the courier's waybill with the note "WITH RESERVATION"). This is the only form of protection in case of anomalies found after opening the package. Such incidents must be reported in writing to the local courier office.
- All product prices listed on the site are expressed in Euros. Unless otherwise indicated, product prices exclude VAT (applied at the legal rate during invoicing) and other taxes. Prices are based on official price lists, if available, in effect at the time of the Customer's order or as listed on the site. Prices listed cancel and replace previous prices, except for more favorable conditions offered by A.D.O. Medical.
- The payment terms and methods specified on the invoice are mandatory. In particular, payment terms are considered essential in the interest of A.D.O. Medical. A.D.O. Medical reserves the right to enforce the contract without prior communication as per Article 1457 of the Italian Civil Code. Payments made under different terms or methods, even if accepted, will be considered as mere tolerance.
- Payments by bank drafts or cheques, even if indicated on the order, are made at the buyer's risk. The buyer is not discharged from their payment obligation unless they prove that A.D.O. Medical has actually collected the payment. In case of theft or loss of cheques, even after receipt by A.D.O. Medical, the company is exempt from any liability or obligation to request duplicates or amortize cheques. Payments made electronically, such as via PAYPAL/Credit Card, are conducted through a secure connection directly linked to the financial institution managing the online payment service. A.D.O. Medical does not have access to the Customer's credit card details and cannot be held responsible for fraudulent use.
- The Customer may raise objections or claims for compensation against A.D.O. Medical only after settling all dues, including capital, interest, and expenses, related to the supplied goods. Any claim against A.D.O. Medical must be filed separately.
- All disputes related to the application, execution, interpretation, or violation of the contract concluded online between the Customer and A.D.O. Medical are subject to Italian jurisdiction. The competent court is in Bologna.
- Images on the website are for illustrative purposes only.
In accordance with Articles 1341 and 1342 of the Italian Civil Code, the Customer declares that they have read all the above General Conditions carefully and expressly accept them.
Right of Withdrawal/Claims
The return of goods can only be carried out with prior written authorization from A.D.O. Medical and following the agreed procedures.
Requests for returns must be made within 10 days of delivery and submitted in writing. (For more details, refer to the page Returns.)
The product must be returned in its original sealed packaging, fully intact. Otherwise, A.D.O. Medical reserves the right to refuse the return.
The package must be accompanied by a delivery note stating "Goods Return."
Returned products for assistance will be considered under warranty only if accompanied by the relevant warranty tag, a copy of the purchase invoice, and a delivery note stating "GOODS RETURN." Otherwise, A.D.O. Medical will apply the applicable assistance rates.
Claims for damages during transport will only be accepted if the goods were received "WITH RESERVATION."
Claims for shortages or transport damages cannot be made if the goods are not accepted "WITH RESERVATION."
Customers are advised to inspect the packaging upon receipt and, if necessary, accept the goods "WITH RESERVATION."
Any anomalies found after opening the package must be reported in writing to the local courier office.
Returns of unauthorized products will not be accepted.
Returned products must include a delivery note referencing the original delivery document and the reason for the return. (For more details, refer to the page Returns.)
Order Cancellation
The sales contract is concluded only upon sending a separate email with the shipping details or an estimated delivery date.
You can cancel your order before receiving the shipping notification, provided the order has not been prepared for shipment.
