General Terms and Conditions of Sale

  1. A.D.O. Medical reserves the right, at its sole discretion, to modify the rules governing these General Terms and Conditions as well as the economic conditions applied to them (due to changes in conditions, foreign exchange variations, increases in raw material costs, or any other reason). Any unfavourable changes will be communicated to the Customer by email to the last address provided by the Customer. In the event of changes unfavourable to the Customer, the Customer may withdraw from the contract within 15 days of receiving the relevant communication. Otherwise, the changes shall be deemed accepted.
  2. A.D.O. Medical reserves the right, at its sole discretion, not to accept incomplete or improperly completed orders. It also reserves the right to withdraw from the contract or suspend its execution at any time without notice and without any compensation being due to the buyer, either as consideration for the withdrawal or as damages.
  3. A.D.O. Medical does not supply products on a trial basis. The Customer is responsible for selecting the ordered products and for ensuring that they meet their requirements.
  4. Delivery times, where indicated, are purely indicative. Any delays shall not give rise to complaints, compensation claims or justify the cancellation of the order. Orders received may also be fulfilled partially depending on warehouse availability or the manufacturer's preparation time for the item. A.D.O. Medical shall not be responsible for service disruptions caused by force majeure of any nature or kind in the event that it is unable to fulfil the requested supply within the agreed timeframes indicated on the page Shipping and Payments. Force majeure causes include, by way of example and not limitation (e.g.: measures by Public Authorities, strikes by its own employees, employees of third-party companies or employees of the carriers used by A.D.O. Medical, as well as any other circumstances beyond its control or independent of its will).
  5. A.D.O. Medical shall deliver the ordered products to the Customer according to the methods described on the page Shipping and Payments, through trusted couriers and/or freight forwarders and/or directly through its own authorised staff. Delivery of products is subject to payment by the Customer of the relevant price using one of the methods made available by A.D.O. Medical.
  6. The fiscal documentation (invoice) is issued by A.D.O. Medical on the basis of the data relating to the User identification provided during site registration or during the checkout procedure for non-registered users.
  7. Unless otherwise agreed, goods are shipped via couriers appointed by A.D.O. Medical and entirely at the Customer's risk. A.D.O. Medical shall not be responsible for damage to products during transport. Customers are therefore advised to check the integrity of the packaging upon delivery and, where necessary, accept the goods “WITH RESERVATION” (the courier's delivery note must be signed adding the wording "WITH RESERVATION"). This is the only form of protection in case any anomaly is detected after opening the package. In such cases the incident must be reported in writing to the local courier office.
  8. All product sale prices indicated on the website are expressed in Euros. Unless otherwise indicated, product prices exclude VAT (at the legal rate applicable at the time of invoicing) and any other tax. Prices are those resulting from official price lists, if any, in force at the time the Customer places the purchase order or otherwise those indicated on the website. The prices of individual Products indicated from time to time on the Website cancel and replace previous ones. Any more favourable conditions applied by A.D.O. Medical shall remain valid.
  9. The payment terms and methods indicated on the invoice are considered binding; in particular, the deadlines are considered essential in the interest of A.D.O. Medical. In any case, A.D.O. Medical always reserves the right to demand fulfilment of the contract without the obligation of notification referred to in art. 1457 of the Italian Civil Code. Payments made with terms or methods different from those indicated on the invoice, even if accepted, shall be considered mere tolerance.
  10. Payment made by bank or cashier’s cheques, even if such method appears on the order, is made entirely at the buyer’s risk, meaning that the buyer is not released from their payment obligation unless they prove the actual collection by A.D.O. Medical. Without prejudice to the above, in the event of theft and/or loss of cheques sent by customers, even after they have been received by A.D.O. Medical, the latter shall be expressly exempt from any liability and from any obligation to request duplicate cheques or their cancellation. Electronic payments made for example via PAYPAL / Credit Card or other electronic methods are carried out through a secure connection directly linked to the banking institution that owns and manages the online payment service with which A.D.O. Medical is affiliated. A.D.O. Medical does not come into possession of the customer's credit card details and therefore cannot be held responsible for any fraudulent use.
  11. The Customer may raise objections or submit compensation claims against A.D.O. Medical only after having paid all amounts due to the company for principal, interest and expenses relating to the supplied goods, and in any case any claim against A.D.O. Medical must be brought in a separate legal action.
  12. Any dispute relating to the application, execution, interpretation or breach of the contract concluded online by the Customer with A.D.O. Medical shall be subject to Italian jurisdiction. For any dispute, the competent court shall be that of Bologna.
  13. The images on the website are for illustrative purposes only.

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Customer declares that they have carefully read the above General Terms and Conditions in all their parts and, after careful review, expressly accept all of them.

Right of Withdrawal / Complaints

The possible return of goods may only be carried out if authorised in writing by A.D.O. Medical and only according to the agreed procedures.
The return request must be made within 10 days from the delivery date and must also be submitted in writing. (NB: for further details please consult the page Returns)
The product must be shipped in its sealed original packaging and must be completely intact; otherwise A.D.O. Medical reserves the right not to accept the return.
The parcel must be accompanied by a transport document stating the reason "Returned goods".
Products returned for assistance, subject to acceptance, will be considered under warranty only if accompanied by the relevant certificate and a copy of the purchase invoice, as well as the transport document indicating the reason "RETURNED GOODS"; otherwise A.D.O. Medical will apply the current assistance charges.
Complaints regarding damage during transport and delivery will only be accepted if the goods were accepted “WITH RESERVATION”.
No complaint for shortages or damage due to transport will be accepted if the acceptance "WITH RESERVATION" has been omitted.
Customers are therefore advised to check the integrity of the packaging upon receipt and, where necessary, accept the goods “WITH RESERVATION”.
This is the only form of protection in the event that any anomaly is detected after opening the parcel.
In such cases the incident must be reported in writing to the local courier office.
Returns of products not expressly authorised by A.D.O. Medical will not be accepted under any circumstances.
Returned products must be accompanied by a delivery note containing the reference to the original transport document and the reason for the return.

Order Cancellation

The sales contract will only be concluded when we send you a separate email with the shipping details or an expected delivery date.
You may cancel your order before receiving the shipping notification, provided that the order has not yet been prepared for shipment.
